  WHAT CAN YOUR CLIENT EXPECT?
 

Step 1- Meeting minimum Criteria

You, as an Introducer will see if your client's Credit Agreement meets the minimum criteria necessary for litigation. You will complete the Financial Claim Review Form outlining the potential claims that can be made. We charge £395 for first Audit and £295 for each subsequent Audit. Payment of any Audit Fees can be made at this stage by Cheque, Credit or Debit Card.

Step 2 - Administration of Claim

You will forward to us the Claim Information using either a Freepost envelope or email. Our customer service team will check to ensure all the relevant information has been included and then pre-populate all the necessary solicitors forms and send back to your client to check, sign and return to us in a freepost envelope.

You will be notified using our Case Tracking system that we have received the Claim Information and how the case is progressing.

Once all the paperwork is received back from your client it will be packaged and sent to the solicitors to begin the Audit Process.

Step 3 - Auditing Your Agreement

The cost for the audit includes a detailed 28 page audit report which sets out the grounds for litigation.

If your clients agreement does not have sufficient grounds for litigation i.e. there are no breaches within the Credit Agreement then they will receive a FULL REFUND OF YOUR AUDIT FEE.

The Audit Fee are required to be paid in full in order for Credit Smart UK to commence the claim process with our Lawyers on your clients behalf. There are absolutely no additional charges associated with your clients claim(s). Your client will receive 100% of the monies that we are able to reclaim on your clients behalf

Step 4 - Your Instruction

Your client will receive notification of the claims that Credit Smart UK are pursuing on their behalf and they will be assigned a solicitor who look after their interests through out the claim process. All correspondence relating to the claim will be provided by the solicitor directly to the client.

Step 5 - Audit Begins

The solicitor will contact the lender requesting all of the relevant information ascertaining to the respective credit agreement under the Data Protection Act. At this time your clients case will passed on to our legal team who will then allocate your case to a solicitor who will pursue the claim on your clients behalf. It is important to point out to your client that there are NO guarantees of success, as with all claims.

Step 6 - Audit Results

Within a maximum time of 60 days you client will receive a 28 page audit report prepared by our legal team. This will detail any breaches in your clients credit agreement and explain the previous case law and grounds for potential litigation. If there are grounds for litigation your clients case will be passed onto our legal team who will proceed to take on the claim on your clients behalf.

Step 7 - Legal Challenge

You client will receive correspondence from their nominated solicitor who will prepare and pursue the claim on their behalf. The document will include the solicitors Terms and Conditions, a Form of Authority and a Conditional Fee Agreement. There are absolutely no further fees applicable at any stage of the claim process. Your legal representative will work in your clients best interest to:

  • Cancel the agreement and clear any outstanding balance
  • Claim back any charges previously paid
  • Interest your clients have previously paid on any outstanding balances
  • Claim for repayments your clients have previously made

There are no further charges to your client if the case is unsuccessful. Please be aware that the legal representation only gets paid upon successful completion of the claim and their success fee is paid by the defendant (the creditor).

Step 8 - Results

 

If successful 100% of the reclaimed money is paid to your client. There are no further payments due whatsoever. The settlement that we will endeavour to secure for your client includes:

  • INTEREST
  • PAYMENTS
  • CHARGES
  • ZERO BALANCE
  • BALANCE PAID IN FULL"
  • - CREDIT FILE ENTRY
